PURCHASE POLICY

RITMO DEL SOL – Purchase Policy

This Purchase Policy (“Policy”) governs all purchases made for RITMO DEL SOL (the “Event”), including Event packages, lodging, upgrades, transportation services, excursions, and any add-ons provided by The Organizer (“we,” “us,” “our”).

By purchasing, registering, or attending the Event, you (“you,” “guest,” “participant,” or “purchaser”) agree to be bound by this Policy.

If you purchase for others, you are responsible for ensuring that all participants receive, understand, and accept this Policy.

1. ALL SALES ARE FINAL

ALL PURCHASES, INCLUDING PAYMENT PLANS AND DEPOSITS, ARE FINAL, NON-REFUNDABLE, AND NON-TRANSFERABLE.

This includes, without limitation:

  • Full purchases
  • Deposits or partial payments
  • Payment Plan installments
  • Single or double occupancy packages
  • Excursions, add-ons, and upgrades
  • Transportation services

No refunds will be issued for:

  • Illness (including COVID-19 or other communicable diseases)
  • Emergencies
  • Travel delays, missed flights, or immigration issues
  • Work conflicts
  • Weather conditions
  • Resort or venue changes
  • Artist changes
  • Unavailability of amenities
  • Personal scheduling conflicts
  • Any reason outside the Organizer’s control

This statement will appear multiple times throughout this Policy for emphasis and clarity.

Once a purchase is made, a legally binding contract is created between you and The Organizer.

2. Eligibility, Age Requirements & License to Attend

  • You must be 18+ to attend.
  • Certain resorts may have stricter age rules; these rules supersede ours.
  • No refunds will be issued for purchases made in violation of these age requirements.

Your credential is a revocable license. We may deny entry or remove any guest—without refund—for:

  • Disorderly, unsafe, aggressive, or threatening conduct
  • Violations of Event or resort rules
  • Providing false information or identification
  • Possession of prohibited items
  • Illegal activity (“Removal Behavior”)

All guests must register in the Guest Dashboard and present valid government-issued identification at check-in.

3. Refunds, No-Refund Policy & Force Majeure

ALL SALES ARE FINAL AND NON-REFUNDABLE.

No refunds, credits, or cancellations will be issued under any circumstances. This includes, without limitation:

  • Illness, emergencies, medical issues
  • Weather or environmental conditions
  • Travel problems (delays, cancellations, immigration denial)
  • Artist cancellations or substitutions
  • Schedule or production changes
  • Resort renovations or amenity limitations
  • Crowd conditions
  • Personal conflicts

The Event will proceed as scheduled unless an extraordinary, unforeseeable, and uncontrollable event makes execution impossible.

This includes:

  • Natural disasters
  • Severe weather
  • Power failures or infrastructure issues
  • Government restrictions
  • Pandemics/epidemics
  • Labor strikes
  • Resort closures
  • Security threats or civil unrest

These circumstances do not create refund eligibility.

Chargebacks are strictly prohibited and violate this Policy. Unauthorized disputes may result in:

  • Cancellation of your package
  • Denial of entry
  • Future purchasing restrictions
  • Collections or recovery actions

4. Travel Packages, Guest Information & Registration Requirements

By purchasing a Travel Package, you understand that:

  • Guest names must be submitted 30 days before the Event.
  • A $100 administrative fee applies to late name changes or additions.
  • Only registered guests physically present with a valid ID may receive credentials.
  • Incorrect or incomplete registration may delay or deny access without refund.
  • Airport, shuttle, and check-in information must be provided accurately and on time.

5. Required Documents & Additional Agreements

Some Event components may require separate forms or waivers, including:

  • Resort forms
  • Transportation agreements
  • Shuttle waivers
  • Excursion liability documents
  • Health or risk forms

Failure to sign required documentation may result in denied access without refund.

Where legally allowed, the Organizer may execute certain documents on your behalf solely to complete your booking.

6. Event Adjustments, Postponements & Cancellations

The Event is designed to proceed under all normal conditions and will only be altered if a situation of exceptional and uncontrollable nature makes it unsafe or unlawful.

We may modify Event elements at any time, including:

  • Schedule or programming
  • Resort assignments
  • Artists or entertainment
  • Amenities
  • Locations or venue spaces
  • Production elements

If postponed, your purchase automatically transfers to the rescheduled dates. Refunds for cancellations are at the Organizer’s sole discretion and may cover only unconsumed elements.

Your purchase is for the overall Event experience—not for any specific artist, amenity, or feature.

7. Payment Terms & Payment Plans

By selecting a Payment Plan, you agree that:

  • Your card will be automatically charged according to the posted schedule.
  • If a payment fails, you have 10 days to resolve it.
  • Failure to resolve will cancel your package with no refunds of prior payments.

The Payment Plan includes:

  • A one-time $100 administration fee for setup and management
  • No interest or finance charges
  • Compliance with U.S. consumer protection laws, including TILA

Chargebacks or payment disputes are prohibited and violate this Policy.

8. Credentials, Wristbands & Entry Rights

  • Wristbands/credentials are non-replaceable, even if lost, stolen, damaged, or tampered.
  • Removing a wristband permanently invalidates it.
  • Credentials may not be resold or used for promotions without written approval.
  • Violation of Event or resort rules may result in immediate removal without refund.

9. Search Procedures, Safety Protocols & Removal

Guests consent to:

  • Bag checks
  • Metal detectors
  • ID verification
  • Security screenings
  • Random inspections

Refusal results in immediate denied entry without refund.

Prohibited items include:

  • Weapons
  • Controlled substances
  • Hazardous objects
  • Professional cameras or recording equipment
  • Any item listed in Event FAQs

Any breach of this Policy or resort rules terminates your license to attend the Event.

10. Resort, Third-Party & Transportation Services

Many Event components are operated by independent third parties. The Organizer is not responsible for:

  • Resort or transportation provider actions or omissions
  • Overbooking or room issues
  • Service failures
  • Inaccurate third-party information
  • Policy changes
  • Delays or cancellations

Some services may require:

  • Deposits or credit holds
  • Identification
  • Additional waivers or signatures

Any disputes with third-party services must be addressed directly with the provider.

11. Photography, Media Rights & Data Sharing

By attending, you grant the Organizer unrestricted rights to:

  • Photograph
  • Film
  • Record
  • Use your likeness, image, and voice in any media

for promotional or commercial purposes. You consent to information sharing consistent with our Privacy Policy.

12. Health, Safety, Event Conditions & Special Effects

The Event environment may include:

  • Loud music and bass
  • Lasers, strobes, haze, fog, pyrotechnics
  • Heat, humidity, sun exposure
  • Water exposure, beach proximity
  • Crowds and fast movement
  • Uneven surfaces

Participation is voluntary and at your own risk.

13. Assumption of Risk & Release of Liability

By purchasing and attending, you voluntarily assume all risks, including but not limited to:

  • Injury, illness, or disability
  • Heat-related conditions
  • Slip/trip hazards
  • Water risks
  • Crowd movement
  • Exposure to communicable diseases
  • Actions or negligence of others

To the fullest extent permitted by law, you release the Organizer from all claims or liabilities. Where liability cannot be excluded, it is limited to the amount you paid or USD $10, whichever is lower.

14. Indemnification

You agree to indemnify and hold harmless the Organizer from any claims, damages, losses, or costs arising from:

  • Your actions or negligence
  • Your breach of this Policy
  • Violations of Event or resort rules
  • Claims by other guests related to your conduct

15. Dispute Resolution, Arbitration & Class Action Waiver

By purchasing, you agree to resolve most disputes through binding arbitration. You waive the right to:

  • A jury trial
  • Class actions
  • Representative or consolidated claims

If arbitration is unavailable, exclusive venue shall be Atlanta, Georgia, unless otherwise required by applicable law.

This clause survives termination of this Policy.

16. Full Agreement & Supplemental Provisions

This Policy constitutes the entire agreement governing your purchase and supersedes all prior statements or representations.

The Organizer may assign rights under this Policy; guests may not.

If any provision is deemed invalid, the remainder remains enforceable.
