Event Terms & Conditions

This agreement shall be deemed reviewed in full and formally accepted by the customer at the time of purchase. The customer, along with all individuals identified on the order, shall also be required to execute—either by physical or electronic signature—a copy of this agreement prior to the commencement of travel. The event terms and conditions may be amended at any time prior to the event date, and the customer will receive advance notice of any such amendments.

Introduction

These General Terms & Conditions (“Terms,” “Agreement”) constitute a legally binding contract between you (“you,” “guest,” “participant,” “purchaser”) and The Ritmo del Sol Organizer (“we,” “our,” “us”) governing your access to and participation in El Ritmo del Sol Cancún (the “Event”), including all Event-related accommodations, transportation, services, on-site operations, digital systems, websites, communications, and any other products or services provided by The Organizer (collectively, the “Services”).

By accessing any Event-related platform, purchasing a Travel Package, attending the Event, or using any Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, do not purchase, do not attend, and do not use the Services.

Definitions

For purposes of this Agreement, the following definitions apply:

  • “Event” means El Ritmo del Sol Cancún, including all scheduled and unscheduled performances, concerts, programming, gatherings, and affiliated activities.
  • “Travel Package” means any bundled offering sold or distributed by The Organizer, including but not limited to: hotel accommodations, event credentials, airport–hotel–airport transportation, optional upgrades or add-ons, and any additional amenities included at the Organizer’s discretion.
  • “Venue” means all Event-related locations including the resort, performance areas, lounges, VIP sections, and transportation points.
  • “Participant” means any person who purchases, uses, or attends the Event under any Travel Package or credential.
  • “Event Rules” means any official policy, restriction, or operational rule established by The Organizer, hotel/resort operator, venue operator, local government, or federal authority.
  • “Credentials” means Event wristbands, room keys, passes, badges, or any identifying material required for entry or participation.
  • “The Organizer” means the company operating and producing El Ritmo del Sol – Cancún, its owners, affiliates, employees, agents, contractors, sponsors, and partners.

3. Acceptance of Terms

By purchasing, accessing, or using any Service, you agree to the following:

  • Comply with all Terms in this Agreement.
  • Comply with all Event Rules communicated before or during the Event.
  • Assume all risks associated with participation, including those described in the Assumption of Risk section.
  • Receive communications, notices, and confirmations electronically.

If purchasing on behalf of others, you are responsible for ensuring that all individuals in your party are aware of, understand, and accept these Terms.

4. Eligibility

To participate in the Event, you must meet all eligibility requirements below:

  • Be at least 18 years of age.
  • Possess the legal authority to enter into binding agreements.
  • Provide accurate, complete, and verifiable personal information.
  • Possess a valid passport for international travel (if not a Mexican citizen).
  • Not be suspended, removed, or banned from any prior related events or services.
  • Children under 18 are not permitted unless expressly allowed in future Event editions. This edition is 21+ recommended and 18+ minimum, subject to change by resort rules.

5. Event Location & International Travel Requirements

El Ritmo del Sol – Cancún takes place at a resort property in Cancun, Mexico. Therefore, the following conditions apply:

  • You are responsible for ensuring compliance with all travel requirements.
  • A valid passport is required for nearly all non-Mexican citizens.
  • Guests who fail to meet travel requirements are not entitled to refunds.
  • The Organizer is not responsible for denied entry to Mexico under any circumstance.
  • Additional Mexican VAT may apply depending on your nationality and documentation presented at check-in.
  • A Travel Package is not refundable if you fail to arrive, are denied entry, or experience travel disruptions.

6. Scope of Agreement

These Terms apply to:

  • All Travel Packages.
  • All on-site services and operations.
  • All Event credentials and wristbands.
  • All transportation services provided or arranged by The Organizer.
  • All communications, digital services, portals, dashboards, and websites related to the Event.
  • All risks, obligations, disclaimers, and liability waivers applicable to participation.

These Terms apply whether purchased directly from The Organizer, through a partner, or through an authorized reseller.

7. Modification of Terms

The Organizer reserves the right to modify these Terms at any time. Changes are effective immediately upon posting on the official Event website. Continued participation in the Event or use of the Services after such updates constitutes acceptance of the revised Terms.

8. Communications & Electronic Records

By purchasing or participating, you consent to:

  • Receive all notices electronically.
  • Accept digital forms, agreements, and signatures as legally binding.
  • Maintain a valid email address capable of receiving Event communications.
  • You agree that info@ritmocancun.com will be the primary point of contact for legal matters, customer service, operational updates, and notices.

9. Travel Packages

Travel Packages for El Ritmo del Sol – Cancún are bundled offerings that may include hotel accommodations, Event credentials, transportation services, meals, amenities, and programmed activities at the discretion of The Organizer. All Travel Packages are subject to availability, change, and substitution.

Purchasing a Travel Package grants you a revocable, limited, conditional license to attend the Event and access the specified services. This license may be revoked at the Organizer’s sole discretion for violation of these Terms or Event Rules.

Travel Packages do not guarantee:

  • A specific room number or location within the hotel or resort.
  • A specific seat, area, or viewing position at any performance.
  • Upgrades, additional amenities, or complimentary benefits.

Any images, descriptions, or sample layouts provided during the purchasing process are illustrative only and may be updated, modified, or substituted based on resort availability and operational needs.

10. Hotel Accommodations

Hotel accommodation included in the Travel Package are provided by third-party resort operators. You acknowledge and agree that:

  • Room assignments are controlled solely by the resort.
  • The Organizer may substitute a comparable resort or room category if necessary.
  • Resort star ratings, descriptions, and classifications may differ from U.S. standards.
  • You must comply with all resort rules, policies, and age restrictions.
  • A security deposit or credit card may be required at check-in for incidentals.

The Organizer is not responsible for:

  • Resort policies regarding noise, smoking, occupancy, damage, or guest behavior.
  • Room amenities or conditions presented by the hotel.
  • Changes to resort branding, management, or operational staff.

10.1 Guest Registration Requirements

You must register all guests through the official Event dashboard (“Guest Dashboard”) before the deadline communicated by The Organizer. The following rules apply:

  • All guest names must be submitted at least 30 days before the Event.
  • A $100 fee applies for late name changes or additions after the deadline.
  • Guests not listed in the Guest Dashboard will not be permitted to check in.
  • Credentials may only be picked up by the registered primary purchaser and the listed guests.
  • Failure to comply may result in delayed check-in or denial of access without refund.

11. Event Credentials (Wristbands, Passes, Badges)

Event credentials are required for access to all Event areas. Credentials must always remain on your person. By accepting credentials, you agree to the following:

  • Credentials are non-transferable and non-replaceable.
  • Damaged, altered, or tampered credentials are void and will not be reissued.
  • Credentials may not be shared or resold.
  • Lost or stolen credentials will not be refunded or replaced.
  • Removing or attempting to remove a wristband invalidates it.

You must present government-issued identification to receive Event credentials. The Organizer may refuse credential distribution if identification is inadequate or invalid.

12. Airport Transportation (Included Service)

Unlike many festivals, The Organizer includes airport transportation in the Travel Package price, subject to the following terms:

  • Transportation is exclusively airport → resort → airport.
  • Only officially designated airports will be eligible (details in guest materials).
  • Transportation is available only on scheduled Event arrival and departure days.
  • You must submit complete flight details by the deadline provided in the Guest Dashboard.
  • Incomplete or late flight information may result in transportation delays or forfeiture.
  • The Organizer is not responsible for missed transportation due to flight delays, cancellations, or personal scheduling conflicts.

If you miss your scheduled shuttle, alternative transport will be at your cost.

13. Resort Transportation & On-Site Movement

Transportation within the resort or between Event venues may be offered at the Organizer’s discretion. You acknowledge that:

  • Internal transport may be limited and is not guaranteed.
  • Schedules may change due to weather, resort logistics, or operational needs.
  • Walking distances may vary.
  • On-site staff may direct or reroute guests as needed.

The Organizer assumes no liability for delays, missed performances, or schedule conflicts caused by internal transportation limitations.

14. Event Schedule, Programming & Artist Lineup

The Event schedule and lineup are subject to change at any time and without notice. You understand and agree that:

  • Performances may be rescheduled, delayed, relocated, modified, or canceled.
  • The lineup may change due to artist illness, travel delays, safety protocols, or force majeure events.
  • No refund or credit will be issued due solely to changes in lineup or schedule.
  • Headliner substitutions do not qualify for refunds.
  • The Organizer does not guarantee that all advertised artists will perform.

15. Venue Rules & Entry Conditions

To maintain a safe and enjoyable environment, you agree to comply with all Venue and Event Rules, including but not limited to:

  • Prohibited items
  • Entry searches
  • Bag checks
  • Age restrictions
  • Noise guidelines
  • Alcohol service policies
  • Footwear or dress code requirements
  • Safety and emergency instructions

Violation of Event Rules may result in immediate removal without refund.

16. On-Site Behavior Requirements

To protect all participants, you agree to:

  • Follow staff instructions at all times.
  • Maintain respectful and non-disruptive behavior.
  • Avoid violence, harassment, discrimination, or threats.
  • Avoid damaging resort property or Event infrastructure.
  • Refrain from activities that endanger yourself or others.

Failure to comply may result in:

  • Credential confiscation
  • Removal from the Event
  • Liability for damages
  • Notification to local authorities

17. Prohibited Conduct

You are strictly prohibited from engaging in the following:

  • Reselling or attempting to resell credentials
  • Using false identification
  • Providing fraudulent information
  • Attempting to enter restricted areas
  • Recording artists where prohibited
  • Public intoxication or illegal drug use
  • Destroying or damaging Event property
  • Harassing staff, artists, or other guests

The Organizer reserves the right to remove any participant whose conduct threatens the safety or enjoyment of others.

18. Health & Safety Requirements

By attending the Event, you acknowledge and agree that:

  • Loud music, lighting effects, lasers, and pyrotechnics may be present.
  • Use of fog, haze, strobe lights, or special effects may occur.
  • Individuals with medical conditions, including pregnant individuals, should consult a physician before attending.
  • You may be required to comply with public health directives issued by local or federal authorities.
  • The Organizer may implement health screenings or preventative measures when necessary.

19. Search & Screening Procedures

To ensure safety, you consent to:

  • Bag searches
  • Security screenings
  • Metal detectors
  • Random inspections
  • Verification of identification

If you refuse a search, you may be denied entry without refund.

20. Photography, Audio & Video Recording

You understand and agree that the Event is a public event. By attending, you grant The Organizer the unrestricted right to:

  • Record, photograph, or film you.
  • Use your image, voice, likeness, and statements for promotional purposes.
  • Publish such materials in any media now known or later developed.

This permission is granted without compensation, credit, or additional consent.

21. Weather & Environmental Factors

The Event takes place in an outdoor tropical environment. You agree that:

  • Weather conditions may affect programming.
  • Performances may be delayed, modified, or relocated.
  • No refunds will be issued due to weather-related changes.

You assume all risks associated with heat, sun exposure, humidity, rain, or other environmental factors.

22. Force Majeure

The Organizer will not be liable for failure to perform obligations if such failure results from events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Governmental restrictions
  • Acts of terrorism
  • Pandemics or epidemics
  • Resort closures
  • Power outages
  • Strikes or labor disputes
  • Severe weather conditions

In such cases, refunds may be limited or unavailable.

23. Assumption of Risk

By attending El Ritmo del Sol – Cancún, you acknowledge and agree that participation involves inherent risks, both known and unknown, including serious injury, illness, disability, property damage, or death. These risks include, without limitation:

  • Actions or inactions of other guests, participants, staff, or third parties.
  • Facility hazards, unstable surfaces, stairs, or uneven ground.
  • Loud music, lasers, lights, pyrotechnics, fog, haze, and other theatrical effects.
  • Exposure to heat, humidity, rain, or extreme weather.
  • Exposure to communicable diseases, viruses, or pathogens.
  • Venue congestion, crowd movement, pushing, or accidental contact.
  • Risks associated with swimming pools, beaches, and ocean environments.
  • Risks associated with alcohol consumption or dehydration.
  • Risks related to transportation, including shuttles, walking paths, and resort vehicles.

You voluntarily assume full responsibility for all such risks and agree that The Organizer shall not be liable for any resulting injuries, damages, losses, or claims except where prohibited by law.

24. Medical Services & Emergencies

Medical services may be provided on-site by third parties. You acknowledge the following:

  • The Organizer does not guarantee immediate or professional-level medical care.
  • Medical personnel may be independent contractors, not employees of The Organizer.
  • You are solely responsible for all costs associated with medical treatment.
  • Emergency services or hospital transfers may involve significant additional costs.

In the event of a medical emergency, The Organizer may arrange or request emergency transport but assumes no liability for the outcome or performance of medical care.

25. Communicable Disease Waiver

You acknowledge and agree that:

  • There is an inherent risk of exposure to communicable diseases at any event.
  • The Organizer cannot eliminate the risk of illness or infection.
  • You assume full responsibility for all risks related to exposure.
  • By attending the Event, you waive all claims against The Organizer relating to: COVID-19, Influenza, Foodborne illness, and any viral, bacterial, or other communicable condition.

26. Disclaimer of Warranties

To the maximum extent permitted by law, the Event and all Services are provided “AS IS”, “AS AVAILABLE,” and “WITH ALL FAULTS.” The Organizer makes no representations or warranties of any kind, express or implied, including but not limited to:

  • Habitability or fitness for a particular purpose
  • Accuracy of schedules, descriptions, or promotional materials
  • Reliability of resort services, amenities, or infrastructure
  • Availability of artists, performances, programming, or activities
  • Security of digital platforms or communications
  • Safety of transportation or resort operations

No oral or written information from The Organizer creates any warranty not expressly stated in these Terms.

27. Limitation of Liability

To the fullest extent permitted by law, you agree that The Organizer, its owners, affiliates, officers, directors, agents, contractors, successors, and employees (collectively, the “Released Parties”) shall not be liable for:

  • Personal injury, death, or disability
  • Property damage, theft, or loss
  • Missed performances or schedule changes
  • Resort or venue conditions
  • Acts of third parties
  • Delays, transportation issues, or travel disruptions
  • Weather, environmental, or natural events
  • Lost, stolen, or damaged credentials
  • Lost wages, lost profits, or indirect damages
  • Damages arising from force majeure events

Where liability cannot be excluded, it is strictly capped at the lesser of (a) the total amount you paid, or (b) $10 USD. This limitation applies regardless of the legal theory used, including negligence.

28. Additional Limitations

The Organizer is not responsible for:

  • Airfare, travel costs, or transportation not explicitly included in your Travel Package.
  • Acts or omissions of third-party vendors or contractors.
  • Lost or delayed bags, missing personal items, or damaged belongings.
  • Consequential, exemplary, special, or punitive damages.
  • Some jurisdictions do not permit certain disclaimers; in such cases, the minimum legally permitted limitation applies.

29. Indemnification

You agree to defend, indemnify, and hold harmless The Organizer and the Released Parties from all claims, damages, liabilities, losses, costs, and expenses (including attorney fees) arising out of:

  • Your participation in the Event
  • Your breach of these Terms
  • Your violation of Event Rules
  • Your conduct or negligence
  • Claims by other guests resulting from your actions
  • Damage to resort or Event property

This indemnity continues even after the Event has concluded.

30. Third-Party Services & Contractors

Many Event components are operated or provided by independent third parties. These include:

  • Hotel/resort operators
  • Transportation companies
  • Medical staff
  • Security personnel
  • Vendors and concessionaires
  • Contractors and suppliers

You acknowledge that:

  • These third parties are not agents of The Organizer.
  • The Organizer is not liable for their acts, errors, omissions, or negligence.
  • All disputes regarding third-party performance must be taken up with the third party directly.

31. Damage to Property

You are responsible for any damage you cause to resort property, Event equipment, or third-party facilities. Damage charges may be applied to the credit card on file or billed separately. The Organizer may remove you from the Event for causing damage, without refund.

32. Removal from Event

The Organizer reserves the right to remove any participant at its sole discretion for:

  • Violating Event Rules
  • Creating a safety hazard
  • Using false identification
  • Disorderly, dangerous, or disruptive behavior
  • Harassment, violence, or threats
  • Possession or use of illegal substances
  • Property destruction

Removal from the Event results in:

  • Immediate confiscation of credentials
  • Denial of re-entry
  • No refund or credit

33. Lost or Stolen Items

The Organizer is not responsible for loss, theft, or damage to:

  • Bags or luggage
  • Phones, electronics, or valuables
  • Wallets, IDs, or passports
  • Clothing or personal accessories

Lost & Found services may be provided but without guarantee.

34. Alcohol & Substance Use

You must comply with all laws and resort policies regarding alcohol and controlled substances. The Organizer may remove you without refund if you:

  • Are intoxicated to the point of endangerment
  • Possess illegal drugs
  • Endanger yourself or others

The Organizer is not responsible for injuries or damages relating to intoxication.

35. Pool, Beach & Water Activity Risks

The Event may take place near beaches, pools, or ocean access areas. You acknowledge:

  • Water environments pose unique risks.
  • No lifeguards may be on duty.
  • Swimming or water activity is at your own risk.
  • Alcohol consumption increases risk significantly.

The Organizer is not responsible for water-related injuries or fatalities.

36. Accessibility & Special Accommodations

The Organizer will make reasonable efforts to support guests with disabilities. However:

  • Request must be submitted in advance.
  • Resort accessibility varies and may not be fully compliant with all standards.
  • Not all areas may be accessible.

37. Dispute Resolution Overview

This section contains a binding arbitration agreement and a class action waiver that affect your legal rights. Please read carefully.

By attending El Ritmo del Sol Cancún, using the Services, or purchasing a Travel Package, you agree that:

  • Most disputes must be resolved through binding arbitration, not in court.
  • You waive your right to a jury trial.
  • You waive your right to participate in a class action, mass action, collective action, or representative action against The Organizer.
  • This agreement is intended to be interpreted broadly to cover all disputes between you and The Organizer.

38. Agreement to Arbitrate

Except for disputes expressly excluded in Section 42, you and The Organizer agree that any dispute, claim, or controversy, whether based in contract, statute, tort, fraud, misrepresentation, or any other legal theory, arising out of or relating to:

  • Your purchase or use of a Travel Package
  • Your attendance at the Event
  • These Terms
  • The Services
  • Your relationship with The Organizer

shall be resolved exclusively through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, or if applicable, its Comprehensive Arbitration Rules. The arbitration will be conducted by a single arbitrator who is either a licensed attorney with at least 10 years of experience, or a retired judge.

39. Governing Law (Georgia)

This Agreement, including the arbitration agreement, is governed by the laws of the State of Georgia, without regard to conflict of law provisions. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of the arbitration provisions.

40. Location of Arbitration

Unless you and The Organizer agree otherwise, arbitration will take place in Atlanta, Georgia, or by telephone, or by video conference, or through written submissions, if the arbitrator determines that no in-person hearing is necessary.

41. Fees & Costs

Arbitration fees will be governed by JAMS rules. If the arbitrator determines that your claim is frivolous, unreasonable, or brought for an improper purpose, you may be required to pay The Organizer’s legal fees and arbitration costs.

42. Exceptions to Arbitration

The following disputes are not required to be arbitrated:

  • Claims filed in small claims court, if they qualify.
  • Claims related to intellectual property rights.
  • Claims where arbitration is prohibited by law.

All other disputes must be brought to arbitration.

43. Timing Requirements

Any claim must be filed within one year of the date on which the claim could have reasonably been discovered. Failure to file within this period permanently bars the claim.

44. Class Action Waiver

You agree that:

  • All claims must be brought on an individual basis.
  • You may not bring a claim as a plaintiff or class member in: class actions, collective actions, mass actions, representative actions, or private attorney general actions.

The arbitrator has no authority to hear claims on a class-wide basis, consolidate claims, or award relief to anyone other than the individual party. If the class action waiver is found unenforceable, the entire arbitration agreement becomes void for that claim only, and the claim may proceed in court exclusively in Atlanta, Georgia.

45. Court Venue (If Arbitration Does Not Apply)

If a dispute is permitted to proceed in court, or if the arbitration agreement is deemed unenforceable for that specific dispute, you agree that:

  • The exclusive venue shall be the state or federal courts located in Atlanta, Georgia.
  • You waive all objections to personal jurisdiction and venue.
  • You waive your right to a jury trial.

46. Severability

If any part of this arbitration agreement or class action waiver is deemed invalid, the remaining portions remain fully enforceable except as described in Section 44.

47. Survival

This arbitration agreement survives:

  • Event cancellation
  • Credential revocation
  • Removal from the Event
  • Travel Package expiration
  • Termination of the Event
  • Your participation or non-participation
